Nestl Sued Again For Falsely Representing Bottled Tap Water As Naturally Spring

A Chicago-based business has sued Nestlé over claims that the five gallon jugs of Ice Mountain Water it purchased for its office dispensers were falsely advertised as containing natural spring water when in reality they were simply filled with regular tap water.

It’s not that The Chicago Faucet Shoppe is unaware that many brands of bottled water on the market today tout the same stuff that flows into every kitchen sink. In fact, bottled water increasingly comes from the tap. A 2009 report found that nearly half of the bottled water in PET plastic bottles came from municipal sources.The company simply contends that Nestlé is misrepresenting its product by blatantly claiming that it’s something other than it is.

The Chicago Faucet Shoppe had been buying Ice Mountain Water since 2008 believing it to be true spring water containing naturally occurring minerals. It wasn’t until July 2012 that an executive at the company was tipped off to the water’s true origins by an employee.

Foreign exchange negatively impacted sales by 0.6%. Reported sales in Zone EMENA increased by 4.5% to CHF 21.1 billion.

Zone EMENA reported high single-digit organic growth, reaching the highest level in the last decade. Growth was supported by continued evolution of the portfolio toward fast-growing categories and channels, as well as innovation. All markets posted positive growth, with strong sales developments led by the United Kingdom, Russia, Italy and France. The Zone continued to see broad-based market share gains, particularly for pet food, coffee, ambient and chilled culinary.

It May Contain Arsenic

Consumer Reports conducted a recent test of 45 bottled water brands. The results showed that Starkey Spring Water, which has been sold at Whole Foods for five years, had concerning levels of arsenica toxic metal.

More specifically, Starkey Spring Water had three times the amount of arsenic than any other brand tested. While the arsenic levels still fell just beneath the maximum limit of 10 parts per billion , CR believes that level is too high, The Guardian reports. Additionally, this isn’t the first time Starkey has been called out for having arsenic levels that are alarmingly high. In fact, in 2019, one of the brand’s samples clocked in at 10.1 ppb, exceeding the federal limit.

But others who disagree have written to the regional water board to express their thoughts. “Florida’s water needs to be protected. We need clean drinking water and taking so much more water out of Ginnie will stress the supply to the Santa Fe River,” one Jacksonville resident wrote.

Nestle is selling its North American bottled water business to a pair of private equity firms in an effort to focus on high-end hydration products.

One Rock Capital Partners and Metropoulos and Co. will pay $4.3 billion for eight Nestle water brands including Poland Spring, Pure Life, Deer Park and Zephyrhills along with the ReadyRefresh office beverage delivery service.

Nestle announced the deal Wednesday as it works to revamp its massive bottled water business, which struggled with declining sales last year.

Metropoulos and Co. boss Dean Metropoulos the Greek-born billionaire known for turning around struggling outfits such as Hostess Brands and Pabst Brewing Company will take over as the chairman and interim CEO of Nestle Waters North America after the sale closes this spring.

The Connecticut-based business has some 7,200 employees in the US and Canada and 27 production facilities across North America, according to a news release.

This is an important inflection point for the business as it transitions to an independent company, Metropoulos said in a statement.

Real Water bottled alkaline water has been potentially linked to non-viral hepatitis, a liver disease that causes inflammation.
